Preamble to the General Conditions of Sale


These general conditions of sale apply to all services provided by:

Article 1 - Content and Scope of Application

These general conditions of sale apply automatically to the following services:

Remote consultations

Initiations and deepening of holistic well-being and personal developments

Mr. Pierre Vernay reserves the right to refuse any service that does not fall within the framework of the training he has received and validated by his certifications or in-person training certificates, which he keeps updated on the site. Link

The different techniques offered and practiced have no medical purpose and are not assimilable to acts reserved for healthcare professions regulated by the Public Health Code and Decree No. 96-879 of October 8, 1996. They are considered complementary and in no way substitute for the medical field reserved for healthcare professions. They are part of a complementary and personal approach to self-work for anyone who consults.

Pierre Vernay's use of the terms "energy treatments," "consultations" is not intended in a medical dimension but in a holistic/energetic approach and taking into account the person who requests his support: his practice consists of taking care of others by accompanying them towards a realignment of their bodies and minds. His many treatments have led to numerous calming effects and improvements in the person being treated. It is for the sole purpose of providing this support that he carries out these consultations. The provider always works in conjunction with traditional medicine and never encourages its substitution. He offers himself as a complementary support approach, directly linked to accompanying healthcare professionals if they wish, otherwise without ever contradicting their expertise or recommendations.

These general conditions of sale apply to the exclusion of all other conditions, and in particular those applicable to internet sales or through other distribution and marketing channels. The sale is deemed to be concluded on the date of acceptance of the order or immediate purchase by the seller. Either:

at the time of booking an appointment for the provision, defined between the service provider and the client (by phone, email, or directly via the website www.pierrevernay.com)

on the date of the client's registration for an initiation or deepening date proposed by the service provider (by email, telephone, or directly via the website www.pierrevernay.com)

Any order or immediate purchase implies unconditional adherence to these general conditions of sale, which prevail over any other conditions, except those expressly accepted by the seller. The buyer declares that he has read these general conditions of sale on the site www.pierrevernay.com and has accepted them before his immediate purchase or the placing of his order by making an appointment for a service or registering for an initiation, deepening, and/or program.

Article 2 - Pre-contractual information

2.1 Prior to the immediate purchase or placing of the order and the conclusion of the contract, these general conditions of sale are communicated to the buyer, who acknowledges receipt.

2.2 The following information is provided to the buyer on the website www.pierrevernay.com in a clear and understandable manner:

the essential characteristics of the goods or services; the price of the goods or services; all additional transport, delivery, or postage costs and any other possible costs; in the absence of immediate performance of the contract, the date or deadline by which the service provider undertakes to deliver the goods or perform the service, regardless of its price; information about the identity of the service provider, its postal, telephone, and electronic contact details, and its activities, as well as information relating to legal guarantees, the functionalities of digital content, and, where appropriate, its interoperability, the existence and terms of implementation of guarantees, and other contractual conditions.

2.3 The service provider communicates the following information to the buyer on the website www.pierrevernay.com:

his name or business name, the geographical address of his establishment and, if different, that of the head office, his telephone, his email address;the terms of payment, delivery, and performance of the contract, as well as the methods provided by the professional for handling complaints; in the event of a sale, the existence and terms of exercise of the legal guarantee of conformity provided for in Articles L. 217-1 and following of the Consumer Code, the guarantee of hidden defects provided for in Articles 1641 and following of the Civil Code, and, where applicable, the commercial guarantee and after-sales service referred to in Articles L. 217-15 and L. 217-17 of the Consumer Code; the duration of the contract, when it is concluded for a fixed term, or the conditions for its termination in the case of an indefinite-term contract.

2.4 The service provider indicates, with regard to digital content:

any relevant interoperability of this content with certain hardware or software that the professional has or should reasonably have knowledge of.

2.5 Concerning a service, the service provider provides the following additional information before the conclusion of the contract or, in the absence of a written contract, before the performance of the service:

information relating to its contact details, its service provision activity, and other contractual conditions.

2.6 The service provider must communicate to the buyer, or make available to him, the following information:

status and legal form, contact details allowing quick contact and direct communication with him;

where applicable, the registration number in the trade and companies register or in the directory of trades;

for activities subject to an authorization regime, the name and address of the authority that issued it;

for the service provider subject to value-added tax and identified by an individual number in accordance with Article 286 ter of the General Tax Code, his individual identification number;

for the service provider who is a member of a regulated profession, the reference to the professional rules applicable to him, the indication of his professional title, the State in which it was granted and the name of the order or the professional organization to which he belongs;

his general terms and conditions of sale; information on the right of withdrawal (existence, conditions, deadlines, the procedure for exercising this right, and the standard withdrawal form), the termination clause and other important contractual conditions.


Article 3 - Order and Conclusion of the Contract

3.1 The buyer can place his order or proceed to an immediate purchase on the website www.pierrevernay.com. The contract is concluded at the time of the order or immediate purchase.

3.2 The buyer may also place an order or proceed with an immediate purchase by phone or email. The contract is concluded at the time of the order or immediate purchase.

3.3 The buyer acknowledges that he has been informed of the time of conclusion of the contract and that he has been informed of the communication of these general conditions of sale.

3.4 The buyer has the possibility, before the conclusion of the contract, to check the details of his order and its total price and to correct any errors before confirming his order to express his acceptance. The confirmation of the order implies the acceptance of these general conditions of sale.

3.5 The service provider communicates to the buyer, on a durable medium and no later than at the time of delivery, the confirmation of the order containing at least the following information:

the essential characteristics of the goods or services;

the price of the goods or services;

the date or deadline by which the professional undertakes to provide the service.


3.6 The buyer's data recorded and stored by the service provider constitute proof of the order and all previous transactions. The data recorded by the payment system constitutes proof of the financial transactions.

Article 4 - Prices

4.1 The prices of the services are indicated in pounds sterling (£) on the website www.pierrevernay.com and are inclusive of all taxes.

4.2 The service provider reserves the right to modify his prices at any time, while guaranteeing the buyer the application of the price in force on the day of the order.

4.3 The prices do not include processing, shipping, transport, and delivery costs, which are invoiced in addition, under the conditions indicated on the website and calculated before the order is placed.

4.4 The payment requested from the buyer corresponds to the total amount of the purchase, including these costs.

4.5 An invoice is drawn up by the service provider and given to the buyer upon delivery of the ordered services.

Article 5 - Payment Methods

5.1 The price is payable in cash, in full, on the day of the order. Payment can be made by credit card or bank transfer.

5.2 Payments made by the buyer will only be considered final after effective collection of the sums due by the service provider.

5.3 The service provider is not required to provide the services ordered by the buyer if the price has not been paid in full under the conditions mentioned above.

Article 6 - Performance of the Service

6.1 The service provider undertakes to execute the services ordered by the buyer within the time specified on the website www.pierrevernay.com.

6.2 In the event of unforeseen circumstances or force majeure, the service provider undertakes to inform the buyer as soon as possible and to find a solution to ensure the performance of the service.

6.3 The performance of the service will be carried out at the agreed location indicated on the website www.pierrevernay.com or by telephone or email.

6.4 In case of non-execution of the service, the buyer's account will not be debited.

6.5 The service provider undertakes to take the necessary care and diligence in the provision of the services ordered.


Article 7 - Right of Withdrawal


7.1 The buyer has a right of withdrawal, which he can exercise within 14 days from the conclusion of the contract. The buyer is not required to justify his decision.

7.2 The buyer exercises his right of withdrawal by sending an email to pierrevernaybusiness@gmail.com, specifying his name, address, and order number.

7.3 In the event of the exercise of the right of withdrawal within the aforementioned period, only the price of the services purchased will be refunded; the costs of returning the services remain the responsibility of the buyer.

7.4 The refund will be made within 14 days following the date on which the service provider is informed of the buyer's decision to withdraw.

Article 8 - Proof and Archiving

8.1 The service provider will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

8.2 The computerized registers will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.


Article 9 - Liability


9.1 The service provider cannot be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure, as defined by the case law of the English courts.

9.2 The service provider cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, including a break in service, external intrusion, the presence of computer viruses, or any other occurrence qualified as force majeure.

9.3 The service provider does not assume any responsibility for the breach of the contract concluded in the event of a fortuitous event or force majeure, as defined by the case law of the English courts.

Article 10 - Applicable Law and Jurisdiction

10.1 These general conditions of sale are subject to English law.

10.2 In the event of a dispute, the English courts will have exclusive jurisdiction.

Article 11 - Personal Data

11.1 The service provider collects and processes the buyer's personal data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR) and the national legislation in force.

11.2 The personal data collected and processed are the subject of a declaration to the National Commission for Information Technology and Civil Liberties (CNIL).

11.3 The buyer has the right to access, rectify, and oppose his personal data, for legitimate reasons, at any time. To exercise these rights, the buyer must send a letter to the following address: pierrevernaybusiness@gmail.com.

11.4 The data collected and processed by the service provider are necessary for the processing of the buyer's order and for the establishment of invoices. They can be communicated to the partners of the service provider responsible for the execution, processing, management, and payment of orders.

11.5 The buyer can also consult the website www.pierrevernay.com, which contains further information about personal data processing.

Article 12 - Language of the Contract

12.1 These general conditions of sale are written in English. In the event that they are translated into one or more foreign languages, only the English text will be deemed authentic in the event of a dispute.
